Chuck Poche assists his clients by developing strategies in a wide variety of commercial real estate transactions. These transactions include the acquisition and disposition of property, commercial development, a broad range of financing transactions, including workouts and foreclosures, and both office and retail leasing. He also has significant experience forming and structuring a variety of real estate entities in connection with commercial development, and he counsels clients with respect to transaction structures and strategies.

Mr. Poche’s creative approach and ability to solve complex business and legal issues enable him to turn obstructions into opportunities for his clients. By striking a balance that considers both legal issues and a clients’ business objectives, Mr. Poche creates unique and economical solutions for clients, regularly navigating complex issues in a cost-efficient and timely manner.

Specifically, Mr. Poche counsels developers and commercial owners, institutional lenders and landlords and tenants on myriad real estate matters. He helps developers and owners in connection with the acquisition and disposition of shopping centers, office buildings and apartment projects, as well as advises throughout all stages of the development of retail centers, multifamily projects and build-to-suit projects—including structuring ownership entities with equity partners, creating restrictive covenants, easements and development agreements for office and industrial parks and single-family residential projects, leasing and sales. Additionally, he advises clients with respect to the restructure of debt and equity financing and foreclosure issues for nonperforming properties. Mr. Poche also assists institutional lenders and banks with debt and equity transactions, permanent and construction financing and mezzanine financing and loans on multistate real estate portfolios. His finance practice focuses on syndicated lending transactions, complex workout and debt restructures, including negotiation of forbearance agreements and deeds-in-lieu of foreclosure, foreclosures and real estate auction sales.

Additionally, Mr. Poche helps clients—including landlords and tenants—negotiate office and retail leases, subleases and ground leases.

Borrower Representation: 

  • Represented The Bascom Group, LLC in numerous acquisition and rehabilitation loans from $5,000,000 to over $50,000,000 for multi-family properties.
  • Represented The Bascom Group, LLC in acquisition at foreclosure of multi-family property for $5,000,000.
  • Represented equity partner in $25,000,000 development of condominium units and beach club in Costa Banderas, Mexico.


Development Representation: 

  • Represented developers in acquisition of land for development of lots for single-family homes and sales to homebuilders.
  • Represented developers in acquisition of land for multifamily residential and commercial development and negotiated entity agreements with equity partners.
  • Represented developer in acquisition of portfolio of 4 multifamily properties and assumption and modification of existing CMBS debt.
  • Represented an affiliate of national equity investment firm in connection with sale of project comprised of residential condominiums and office and retail leased space, which consisted of a master condominium unit structure with multiple sub-units.

  • Real estate counsel representing Goldman Sachs in $80,000,000 credit facility secured by over 60 cell towers sites in 5 states.
  • Real estate counsel representing Goldman Sachs in $22,500,000 credit facility secured by over 30 cell towers sites in 5 states.
  • Real estate counsel representing Goldman Sachs in $75,000,000 credit facility secured by over 25 off-site airport parking facilities in 13 states.
  • Real estate counsel representing CapitalSource in $47,530,000 loan secured by 6 automobile dealerships in 5 states
  • Represented JPMorganChase in connection with a $82,000,000 construction loan for acquisition and construction of property pursuant to a ground lease from governmental authority for development of a mixed-use transit-oriented development.
  • Represented JPMorganChase in connection with multiple loans to developer for acquisition and development of sites to be leased for use as retail drug stores.
  • Represented JPMorganChase in connection with a $45,000,000 loan for a build-to-suit for Intel Corporation in Parsippany, New Jersey.
  • Represented Bank of America in connection with a $140,000,000 loan secured by a portfolio of 42 Georgia Pacific facilities located in 24 states.

  • Represented Washington Mutual in numerous SBA loan foreclosures.
  • Represented an affiliate of Centerline Capital Group in foreclosure of $6,400,000 loan secured by multi-family property in Dallas, Texas, and subsequent sale.
  • Represented California bank in foreclosure $13,500,000 loan secured by Texas regional mall.
  • Represented Greystone Servicing Corporation in foreclosure of $5,700,000 loan secured by multi-family property in Houston, Texas, and subsequent sale.Leasing: 
  • Represented an affiliate of national equity investment firm as landlord in connection with all office and retail leasing of The Tower at Sundance, formerly known as Bank One Tower in Fort Worth, Texas.
